Review of Statement of Gambling Principles in accordance with the Gambling Act 2005 pdf icon PDF 89 KB

Minutes:

The Committee received a report which provided members with a draft copy of the revised Gambling Act 2005 Statement of Principles, attached as Appendix 1 to the report, for consideration.

 

Following the Licensing Committee’s consideration of the revised draft Statement of Principles, a 12 week consultation exercise would be entered into in accordance with Section 349(3) of the Act and those persons listed in Appendix A of the draft Statement of Principles would be consulted.Following the completion of this consultation it was intended to report the results back to Licensing Committee on 7 October 2015 for consideration and potential revision of the draft Statement. The draft Statement of Principles would then be reported to Cabinet on 13 October 2015 to consider the recommendations and then recommended for adoption at full Council on 10 November 2015.

 

The Committee were advised that the proposed changes to the current Statement of Principles were minor and amounted to some layout changes and further clarification in some areas.  There were no proposed significant changes to policy at this time.  Changes to the Statement of Principles were highlighted in Appendix A for information, and summarised below:

 

      Movement of the Area Profile (including map) into the main part of the document rather than appearing as an appendix. This is due to the Guidance from the Gambling Commission specifying that it be      included in the Statement of Principles

      Declaration and details of Licensable Activities made more obvious as these are required to be included in the Statement of Policy and it is important that they are easily identified

      Update regarding the position of the National Lottery Commission which is now part of the Gambling Commission.

 

The Committee were also asked to consider whether a resolution should be made under Section 166 of the Act – not to issue a casino licence.  There was no requirement to consider such a resolution and declining to do so would not restrict the authority from making a future resolution. As it was most unlikely any of the permitted casinos would seek to operate in this district, officers were recommending that a resolution at this time was not considered justified or necessary.

 

In the discussion which followed, the Licensing Manager advised that any residents or organisations that were holding charitable events that were unsure as to whether they require a licence should contact the Licensing Team for advice as it would depend on the circumstances.

 

Having considered the recommendations in the report and the draft copy of the revised Gambling Act 2005 Statement of Principles, the Committee accordingly

 

RESOLVED that

 

1)     the draft Statement of Principles attached at Appendix A be approved for consultation for a period of 12 weeks, commencing in July 2015.

2)     it be stated in the draft Statement of Principles that there is no necessity for the Council to make a resolution under Section 166 of the Act not to issue a casino licence at this time.
