The minutes of the meeting of the Policy Advisory Group (PAG) held on 3 March 2016 were received.

Minutes:

The PAG received a report regarding the Annual Treasury Management Report 2015/16, and were asked to note the investment performance of the Council.

 

The report showed the change in investments over the course of the year, the net reduction overall of approximately £3m was attributable mainly to the expenditure on the capital programme, use of s106 funds and distribution of the Green Deal funding.  The overall income for the year was £366k, a shortfall against the budget of £400k, but less than had been forecast.

 

Members found the graph illustrating the cash flow over the course of the year helpful, and officers confirmed that the graph would feature in future reports, and would include the previous year’s trend for comparison.  Some members were interested in the detailed figures underlying the graph and it was agreed these would be circulated separately to RPAG members when future reports are published.

 

In the discussion on the report members were made aware that the Council’s treasury management strategy may well change if the Council decides it needs borrow to finance its future plans.  If that were to be the case then reports would come to members to amend the Treasury Management Strategy.     

 

 

After discussions with the PAG, the Portfolio Holder agreed that the PAG would:

 

1.    Note the investment performance for 2015/16 as required by the Code of Practise for Treasury Management.

Parking Service - Off Street Parking Legislation

To consider the report of the Head of Environment.

Minutes:

The Members of the PAG received a report detailing the legal framework which governs parking enforcement, in order to determine whether to align South Bucks District Council with Chiltern District Council to enable all car parks across Chiltern and South Bucks to be enforced under the Traffic Management Act 2004.

 

The report explained to Members that as a Joint Parking Service had now been created, processes need to be aligned in order to manage efficiencies. Currently, CDC enforces using the Traffic Management Act 2004 (TMA), which SBDC using the Road Traffic Regulation Act 1984 (84 Act), with TMA falling under Civil Law, and 84 Act falling under Criminal Law. SBDC is the only authority within Buckinghamshire that enforces On and Off Street parking under two separate acts.

 

The adoption of TMA for both on and off street parking would mean the adoption of powers to carry out Off Street enforcement. This would also lead to a reduction in judicial costs as appeals and debt recovery are currently dealt with by the Magistrates Court, incurring solicitor’s fees: under TMA, debt recovery can be passed to the debtor and recovered alongside the registered debt. As the TMA framework is used across all other parts of the County it was felt this would make it easier for customers.

 

The report went on to detail to Members that the estimated reduction of overall car parking income would be as a worst case 1.8%, however it was felt that using a more efficient recovery framework would reduce this figure .

 

After discussion within the PAG, the Portfolio Holder agreed that:
