To approve the settlement agreement with Affinity Water Limited in
relation to the grant of
an easement acquired under compulsory powers enshrined in the Water
Industry Act 1991
for their works at Bury Farm, Amersham and Lower Bottom Farm,
Amersham. Carter Jonas,
as valuers for the Council, recommend the settlement sum as the
required compensation. A
schedule of agreed claim items and fees apportionment is attached
in the Confidential
Appendix. It has been agreed that Affinity Water will pay
Buckinghamshire Council a
settlement inclusive of the agreed fees payable to the
Council’s land agents. Carter Jonas
recommend the settlement as being in full settlement of the claim
available to the Council.
Reasons for the decision:
The Council is entitled to compensation
equating to the value of the rights acquired by Affinity
Water.
Alternative options considered:
There are no other options available to the
Council due to the statutory power acquired by
Affinity Water under the Water Industry Act 1991.
