Decision:
The Council approves the grant of a Deed of
Variation to move the Tenant break option to 13th March
2025.
Reasons for the decision:
The Tenant has a 10 year lease with an option
to break it in September 2023. The current rent is £30,000
pa. The Tenant has expressed a desire to vacate also, however, they
are not in a position to do so just yet so have requested pushing
the break date out to enable them to assess how the business
continues to trade.
The lease term to remain as existing i.e. expiring as at 13
September 2026. The tenant break option date to be pushed out by 18
months to 13 March 2025 (from 13 September 2023) on 4 months’
notice.
Alternative options considered:
The Council could opt to not allow the
proposed changes which would result in the Tenant handing in their
notice to vacate. If the property were to become vacant the Council
would become liable for empty Business Rates, Utilities, ongoing
Repairs and other associated costs in connection with a void unit
meaning a direct expense to the Council. It is therefore in the
Council’s interest to nullify these liabilities for as long
as possible.
