Pursuant to s106 Agreement entered into by Aylesbury Vale District Council (AVDC) and Persimmon Homes (Thames Valley) Ltd. on the 31st March 2006, to note the transfer of Public Open Space at Foskett Way, East of Mandeville Road.

Reasons for the decision:

As a condition of the Planning Permission permitting the residential development of Land at Stoke Mandeville Hospital given to Persimmon Homes by AVDC, Persimmon Homes entered a s106 Agreement (dated 31st March 2006) that obliged them, subject to certain conditions, to transfer a proportion of the site to AVDC as Public Open Space.

The Council’s s106 Monitoring Officer is now satisfied that the land is ready to be transferred to the Council.
The freehold will be transferred to the Council and its use will be restricted to Public Open Space.

A commuted sum of £50,139 was received over 2 tranches in 2012 and 2013 by AVDC for the ongoing maintenance of this Open Space.
