To approve a written agreement (NETWORK ACCESS
AGREEMENT GWA82955/SE-NWNSLW), to be signed between Buckinghamshire
Council and Gigaclear Ltd.
The agreement will allow access to install and maintain Electronic
Communications Apparatus on title number BM335276 & BM306686 a
Plan of the area is included at the conclusion of this OED form.
This is a written agreement made under the Electronic
Communications Code (set out in Schedule 3A to the Communications
Act 2003) ('the Code'). The purpose of the agreement is for
Gigaclear to place electronic communication apparatus on or under
your property as part of their communications network. This
agreement has been approved by the Country Land and Business
Association (CLA) and the National Farmers Union (NFU)
Reasons for the decision:
The agreement allows Gigaclear to allow access
to install and maintain Electronic Communications Apparatus on
title number BM335276 & BM306686, by allowing this to take
place we are helping to improve the Broadband and general internet
connectivity in that area for those residents and local
businesses.
The land is a small section of open space amenity land and as such
has little development potential, the installation would not
adversely affect its current use, and would consist of an length of
cabling being installed in the range of 100.37 m and one associated
data cabinet on the land.
Alternative options considered:
The Council could refuse to sign the
agreement, this however does not support the efforts being made to
facilitate the new fibre optic internet being rolled out
nationwide.
This also affects local residents who will be adversely affected by
the lack of the installation on our land. Gigaclear could
potentially take action against Buckinghamshire Council to force us
to allow the installation under the communications act, this cannot
be refused if fair grounds for such a refusal cannot be cited as
part of any objection we raise.
