Decision:
The Council grants Legal Services the
authority to serve the reply to the Tenant’s notice of claim
to acquire the freehold and approves the disposal of the freehold
interest in respect of 57 Station Road Quainton on the basis of the
value determined in accordance with Section 9 of the Leasehold
Reform Act 1967.
Reasons for the decision:
The Tenant has served notice on the Council as
the freeholder to acquire the freehold title of the house at 57
Station Road under the legislation set out in the Leasehold Reform
Act 1967. Subject to the basis of value being determined in
accordance with Section 9 of the Leasehold Reform Act the notice is
accepted.
Alternative options considered:
The Council could object to the notice which
would mean that if the Lessee wanted to proceed with obtaining the
freehold, it would have to go to the Lands Tribunal to determine
its claim. Legal advice do not support that the Council has a valid
reason to contest the claim.
