The Council:
•gives consent for the assignment of the Lease dated 21stJune
2013 made between Wycombe District Council (1) Berrymede Properties
Limited (2) (“Lease”) and also by way of the licence to
assign to change the overage settlement date.
•approves settlement of the overage payment due under the
Lease with the figure agreed being documented by a Memorandum
Reasons for the decision:
Following an assignment of the Lease, the
settlement of the overage payment is a contractual term under it.
Settlement of the overage at the agreed figure will generate a
capital receipt to fund the capital programme.
Alternative options considered:
The overage is contractual and there are no
alternatives. The granting of permission to change the date of the
overage payment to be simultaneous with the actual assignment of
the lease generates the revenue earlier.
