Decision:

Settlement of Overage held in favour of Buckinghamshire Council in relation to Redhill Farm, Denham.

Reasons for the decision:

Redhill Farm was sold by Bucks County Council in 2002 with a 25 year overage. The overage stated that the council would benefit to receive 25% of any uplift in value derived from the whole or part of the property of which there has been a grant of planning permission.

The current owner has demolished the original dwelling and replaced it with a more modern equivalent comprising a detached 5-bedroom brick dwellinghouse and incorporates a subterranean basement finished to a high quality.

The previous dwelling measured 2,052 q ft and the existing new dwelling measures 3,792 sq. ft, 4,123 sq. ft including the basement. Therefore, an increase of 1,740 sq. ft.

The outline terms of the overage are set out below:
1.Property – Area edged in red on the attached transfer plan
2.Chargeable property – Whole or part of the property of which there has been a grant of planning permission.
3.Base Value – Market value of the chargeable property immediately before the grant of planning permission.
4.Attributable Value – 25% of the enhanced value of the property.
5.Period of overage – 25 years
6.Implementation – The commencement of development.

There were no other options available to the Council.
