BUCKINGHAMSHIRE COUNCILas theRegulatory Authorityfor theConsent Street RESOLVED TO REFUSE THE APPLICATION FOR A STREET TRADING CONSENT.

Reasonsfor thePanel’s Decision

In making their decision, the Panel considered the Application and written representationsin support of and against the application.

The Panelalso tookaccount ofthe legislativeprovisions and theStreet Trading Policyfor the legacy Chiltern area and the factors to be considered including public safety; public order; the avoidance of public nuisance and the highway.

Inparticular, thePanel notedpara 4.14of thePolicy andapplying thePolicy refusedthe Application for Consent for the following reasons:

a.      A significant effect on road safety would arise either from the siting of the trading activity itself, or from customers visiting or leaving the site;

b.      Whilst noting that competition issues are not a consideration, there is already adequate like provision in the immediate vicinity of the site to be used for street trading purposes.

c.       There isa conflictwith Traffic Ordersand waitingrestrictions.
